عدم مشروعیت محاصره دریایی یمن از رهگذر تدقیق در ماهیت مخاصمه مسلحانه در این کشور

چکیده

محاصره دریایی یمن در سال 2015 میلادی، با حضور کشتی‌های جنگی نیروهای تحت ائتلاف به رهبری عربستان سعودی، در آب‌های تحت صلاحیت یمن آغاز شده است. سطور پیش رو بر آن شده است تا از رهگذر تدقیق در ماهیت مخاصمه مسلحانه در یمن، به مسأله مشروعیت یا عدم مشروعیت محاصره دریایی یمن نظر بدوزد. پیامدهای ناگوار ناشی از محاصره دریایی یمن، بایستگی کنکاش در مشروعیت یا عدم مشروعیت محاصره مزبور از منظر حقوق بین‌الملل را ایجاب می‌نماید (مسأله). به این منظور، تحقیق پیش رو، با روش توصیفی - تحلیلی و از طریق گردآوری اطلاعات عمدتاً کیفیِ تحقیق به روش کتابخانه‌ای و به صورت استفاده از اسناد، کتاب-ها، مقاله‌ها و تارنماهای معتبر انجام شده است (روش). برآمد پژوهش منعکس شده در مقاله حاضر، نشان داده است که مخاصمه مسلحانه میان دولت مرکزی یمن یا نیروهای تحت ائتلاف به رهبری عربستان سعودی با کمیته‌های مردمی وابسته به جنبش انصارالله و بخش‌هایی از ارتش یمن، یک مخاصمه مسلحانه غیربین‌المللی است و در نتیجه، این محاصره غیر‌مشروع است. افزون بر این، محاصره دریایی یمن، ناقض موازین حقوق بین‌الملل بشردوستانه، از جمله و به ویژه دستورالعمل سن رمو و پروتکل دوم الحاقی به کنوانسیون‌های چهارگانه ژنو 1949 است (یافته‌ها).

چکیده [English]

Yemen ' s maritime blockade began with the presence of Saudi Arabia led coalition naval forces in 2 0 1 5 in the waters of Yemen and continues to these days . The prohibition of arriving the humanitarian aid, the lack of medicines and medical facilities , the lack of fuel, the severe starvation , the spread of illnesses , including cholera, and finally the destruction of thousands of Yemeni civilians as a consequence of this naval blockade , need to investigate the legality or illegality of the blockade under international law . The present topic has sought by descriptive-analytical method and with regard to collecting mainly qualitative research information by library method and in the form of using documents, books, authoritative articles and related websites. The legal studies state that armed conflict between the Yemeni government or the coalition forces led by Saudi Arabia with the Ansarallah Movement People's Committees and parts of the Yemeni army is non-international armed conflict and so, the blockade is illegal. In addition to the blockade breaches the international humanitarian law, such as the San Remo instruction and the Second Additional Protocol to the Geneva Conventions of 1949.
